Stalking is defined under Section 76-50106.5 of the Utah Criminal Code. 

Under this law, stalking can include actions of:

  • Monitoring
  • Observing
  • Photographing
  • Surveilling
  • Threatening
  • Communicating to or about

Stalking Injunctions

Stalking injunctions are court orders that prohibit the stalker from contacting or going within a certain distance of the victim as well as anyone else listed on the injunction. Thus, these injunctions may impact child custody if the stalker is banned from making any contact with shared children. 

Stalking injunctions can be ordered on a temporary or more permanent basis. Temporary injunctions are granted without a hearing in which the alleged stalker can appear and present evidence. The alleged offender is then given 10 days to respond. Once a hearing is conducted where both parties can plead their cases, the judge will make a ruling based on the evidence heard.
